Draft Order

3 in this application as annexures FA4(a) and FA4(b), together with the changes thereto detailed in the supplementary affidavit and second supplementary affidavit of the applicants, in substitution of certain vested rights of the member beneficiaries against the Trust ("individual policies"), collectively referred to as “the proposed restructure”. 2. An order declaring that the individual policies are validly concluded through the method of acceptance by silence by the member beneficiaries; 3. An order that the proposed restructure occurs four months from the first day of the month following the month in which this Honourable Court grants this relief as set out herein ("restructure implementation date"). 4. Declaring that SANLAM DEVELOPING MARKETS LIMITED is authorised to issue individual policies, attached to the founding affidavit as annexure FA4(a) and FA4(b), together with the changes thereto detailed in the supplementary affidavit and second supplementary affidavit of the applicants, to the member beneficiaries of the Trust, in substitution of vested underwritten benefits removed as a result of the proposed restructure; 5. An order that SANLAM DEVELOPING MARKETS LIMITED issue such policies to member beneficiaries of the Trust forthwith. ___________________________ BY ORDER
