2 DRAFT ORDER HAVING READ THE PAPERS FILED ON RECORD AND HAVING HEARD COUNSEL FOR THE APPLICANTS, THE FOLLOWING ORDER IS MADE: 1. An order in terms of Section 13 of the Trust Property Control Act, 57 of 1988 (“the Trust Property Control Act”) , granting the following proposed restructure without the consent of the member beneficiaries of the Kganya Benefits Fund Trust (“the Trust”): 1.1 A variation of the Kganya Benefits Fund Trust Deed (“the Trust Deed”) by replacing same with the amended and restated Trust Deed attached to the founding affidavit in this application as annexure FA3(b); 1.2 A variation and / or repeal and replacement of regulations made in terms of the Trust Deed (“the existing Regulations”), in the following respect: 1.2.1 by amending and / or repealing and replacing the existing Regulations, with the Regulations attached to the founding affidavit in this application as annexures FA7(b), FA24 and FA25, together with the changes thereto detailed in the supplementary affidavit and second supplementary affidavit of the applicants. 1.3 the concluding of individual policies underwritten by SANLAM DEVELOPING MARKETS LIMITED , attached to the founding affidavit
