29 6.3.4.1.3. “ Member in Good Standing ” means a Member who meets the requirements as set out in regulation 6.3.4.3; 6.3.4.1 4. “ Qualifying Person ” means - 6.3.4.1.4.1 a Member in Good Standing; or 6.3.4.1.4.2 a Dependent Child who predeceases a Member in Good Standing; 6.3.4.1 5. “ Service Provider ” means any service provider appointed by the Trust from time to time; 6.3.4.1.6. “ Service Receiver ” means - 6.3.4.1.6.1 a Member in Good Standing in respect of a Dependent Child who predeceases a Member in Good Standing; or 6.3.4.1.6.2 any other person in respect of the Member in Good Standing; 6.3.4.1.7. “Stillbirth” means the death of a foetus twenty-eight weeks or longer after conception, or immediately prior to, or during delivery; and 6.3.4.1.8. “Territory” means the Republic of South Africa. 6.3.4.2. Funerary Management Benefits 6.3.4.2.1. The Trust may from time to time procure the Funerary Management Benefits from the Service Provider for all Members in Good Standing on the death of a Qualifying Person. 6.3.4.2.2. The Funerary Management Benefits entitle all Members in Good Standing to the benefits as set out in Annexe B.4 as amended from time to time by the Trust. 6.3.4.2.3. Any costs over and above the limits stipulated in Annexe B.4 will be for the cost of the relevant Service Receiver. 6.3.4.2.4. It is agreed that the Trust’s liability for the Funerary Management Benefits shall be limited to procuring the services from the Service Provider as set out in Annexe B.4 . The Trust shall in no manner be involved in respect of the services rendered by the Service Provider, neither shall the Trust be liable for such services. The contractual relationship for the services rendered, shall at all times be between the Service Receiver and the Service Provider. 6.3.4.3. Member in Good Standing for purposes of the Funerary Management Benefits 6.3.4.3.1. The Trust shall only provide the Funerary Management Benefits set out in regulation 6.3.4.2 above in respect of the death of a Qualifying Person if the relevant Member is a Member in Good Standing by virtue of – 6.3.4.3.1.1. payment of a Membership Contribution with a Date of Payment in the Month preceding the Month in which the Date of Death occurred; or 6.3.4.3.1.2. payment of a Membership Contribution with a Date of Payment in the Month in which the Date of Death occurred, provided that the Date of Payment is prior to the Date of Death. 6.3.4.4. Dependent Child / Children 6.3.4.4.1. The following persons shall qualify as a “ Dependent Child ” in relation to a Member in Good Standing for purposes of the Funerary Management Benefits: 6.3.4.4.1.1. a child born to the Member in Good Standing; 6.3.4.4.1.2. a legally adopted child of the Member in Good Standing; and 6.3.4.4.1.3. a child adopted by custom by the Member in Good Standing provided that both natural parents are deceased, and who has been recorded as such in the Payment Receipt Booklet of the Member in Good Standing, subject to the provisions of regulation 6.3.4.4.2 below. 6.3.4.4.2. A newborn child and adopted child of a Member in Good Standing must be recorded in the Payment Receipt Booklet of the Member in Good Standing within a period of 6 (six) months after the date of birth or adoption, as the case may be. 6.3.4.4.3. A Dependent Child specifically excludes a child: 6.3.4.4.3.1. who survives the Member in Good Standing; 6.3.4.4.3.2. who is the child of a Dependent Child (i.e grandchildren); or 6.3.4.4.3.3. who is 25 (twenty five) years or older. 6.3.4.4.4. Notwithstanding the provisions of regulation 6.3.4.4.3.3 above, a child who is 25 (twenty five) years or older will qualify as a Dependent Child to the extent that such child is dependent on the Member in Good Standing due to a physical and/or mental disability, provided that: 6.3.4.4.4.1. such disability existed or occurred whilst the child otherwise qualified as a Dependent Child; and 6.3.4.4.4.2. the Member in Good Standing paid at least 1 (one) Membership Contribution prior to the date that the child would ordinarily cease to be a Dependent Child. 6.3.4.4.5. A child of a Member in Good Standing (who is the father) shall not be a Dependent Child of the Member in Good Standing for purposes of the Funerary Management Benefit unless: 6.3.4.4.5.1. the natural mother is deceased; 6.3.4.4.5.2. the natural mother is not a member of the ZCC; or 6.3.4.4.5.3. the Member in Good Standing is the legal guardian of such child. 6.3.4.4.6. The onus of proving that a child meets the requirement for qualification as a Dependent Child shall be on the Member in Good Standing. 6.3.4.5. Limitations in respect of Funerary Management Benefits 6.3.4.5.1. No person shall have a Claim for Funerary Management Services except for a Service Receiver. 6.3.4.5.2. It is specifically provided that Funerary Management Benefits shall not be provided in respect of – 6.3.4.5.2.1. a Dependent Child who survives the Member in Good Standing; 6.3.4.5.2.2. miscarriages; 6.3.4.5.2.3. abortions; and 6.3.4.5.2.4. Stillbirths. 6.3.4.6. Procedure to claim the Funerary Management Benefits The Service Receiver must deal with the Claim as set out in Annexe B.5 .
