Commencement The LLMRs commencedon1April2021 4. Determinationofdiscounted transportationbenefit TheZCCmaynegotiatewithServiceProvider(s) toprovide theDiscountedTransportationBenefit. Subject to the termsand conditionsof the LLMRs, the DiscountedTransportationBenefitentitlesall Loyal MemberswhohavepurchasedaCurrent Leeto laMoria Receipt topurchase1 (one)DiscountedTicketper Event heldduring the same calendar year inwhich the aforementioned receiptwaspurchased from theService Provider at the ListPrice less50% (fiftypercent) for the sole andexclusivepurposeofattendinganEvent. Thepurchasepriceof theCurrent Leeto laMoriaReceipt shallbeequal toR5.00 (FiveRand)per receipt 5. Election topurchasea ticket Subject to the terms, conditions,exceptionsand limitations of the LLMRsa LoyalMember mayelect topurchasea Current Leeto laMoriaReceiptand thereafter aTicketat theDiscountedPriceonor after theCommencementDate for the soleandexclusivepurposeofattendinganEvent. TheZCCwillarrange thatChurches,onbehalfof theService Provider,makes theTicketsavailable for purchasebya LoyalMember whohaspurchasedaCurrent Leeto laMoria Receiptat least21 (twentyone)daysbeforeeachEventat theDiscountedPrice. TicketsatDiscountedPriceswillonlybe sold toMembers whoproduce their MembershipBooks reflecting that they are LoyalMembersand that theyhavepurchasedCurrent Leeto laMoriaReceiptsduring the same calendar year in which theEvent towhich theTicket relateswillbeheld. 6. Limitationof liability TheDiscountedTransportationBenefit isabenefit procuredby theTrustandaccordingly - no contractual relationshipexistsbetween theTrustand theServiceReceiver; theTicket ispurchasedby theService Receiver in termsofanagreemententered intowith the ServiceProvider. TicketsatDiscountedPricesandmealsaremadeavailable to LoyalMembersonly.The number ofTicketsavailableper Eventat theDiscountedPricewillbe limitedandwillbe soldbyChurchesonbehalfof theServiceProvider ona first come first servebasis. 7. Amendments to theRegulations TheRegulationsmaybeamended inwritingby theTrust in its solediscretionand suchamendments shallbe incorporated into theRegulationswitheffect from thedate specified in suchamendmentor in theabsenceof such date, thedateof signatureby theTrust. 8. TerminationofRegulations TheTrustmay terminate theseRegulations inwritingand shallgivenoticeof the terminationdateviaPayPoints. 9. Delegationand cession TheTrust shallbe entitled toappointoneor more administrators toperform administration services inorder togiveeffect to theseRegulations. TheMember maynot cedeany rightsor delegateanyof its obligations in termsof theseRegulations. TheDiscountedTransportationBenefitmaynotbe ceded, assignedor otherwisepledgedas security. Importantprovisions 3.1To theextent that theConsumer ProtectionActapplies to these EnhancedBenefitsRegulations, theTrusthasaduty topointout certain importantprovisions in theseEnhancedBenefits Regulations. The clauseswhich contain these importantprovisions and reasonswhy theyare importantare setoutbelow. 3.1.1 Limitationof risk, legal responsibilitiesand liability 3.1.1.1Regulation6.3.2.2.6, regulation6.3.3.4.2, regulation 6.3.3.5.2, regulation6.3.4.2.4and regulation6.3.5.2.6.are important because they limitandexclude obligations, liabilitiesand legal responsibilities that theTrustandother personsor entitiesmay otherwisehave toaMember. 3.1.1.2Asa resultof these clauses,aMember's rightsand/or remediesagainst theTrustand theseother personsandentitiesare limitedand excluded.These clausesalso limitandexclude a Member's right to recover or make claims for losses,damages, liabilityor harmaMember or othersmay suffer. 3.1.2Assumptionsof risk, legal responsibilitiesand liabilityby Members 3.1.2.1Regulation6.2.3, regulation6.3.2.2.5, regulation6.3.4.2.3, regulation6.3.3.5.2and regulation6.3.4.4.6are importantbecausea Member takeson risk, legal responsibilitiesand liability.Asa result of these clauses,aMember mayalsobe responsible for claimsand other amounts. AMember willalsobe responsible for,andaccepts, various risks,damages,harm,and injurywhichmaybe sufferedbya Member andothers for what is stated in these clauses 5. Background TheEnhanced Benefits Regulations (" EBRs ")mustat all timesbe read with theMaster Regulations,and all termsand conditions setout in theMaster Regulationsapply to theEBRs. 4. Commencement 4.1TheEBRs commence witheffect from the CommencementDateand shallendureuntil terminatedby theTrust in accordancewith the Master Regulations. 4.2TheEBRs replace in totalityall regulations previously issuedby the Trustdealingwith the samemattersas setout herein,witheffect from theCommencementDate. 6.1. and6.2.1Trust shallprocurebenefits 6.1TheTrust shallprocure certainenhancedbenefits for allMemberswho: (i) satisfy the requirements for membershipas setout in theMaster Regulations; (ii) havepaid their MembershipContributions to theTrust as setout in theMaster Regulations; and (iii)qualifies asaMember inGoodStanding for purposesof the EnhancedAncillaryBenefits. 6.1.2TheTrust shallprocure suchbenefitsusing its bestendeavours in linewith theFinancialSector Charter. 6.2The followingbenefitswillbeprocuredand/or provided to theMembers: (i)access to theThariya BarutiPukwanayaKganyaContract for theprovisionof insurance cover and funeral (burial)benefitsand AdditionalFuneralBenefits in termsofaThariyaBaruti FuneralPolicyand insurance cover anddreaddisease benefits,personalaccidentbenefitsandAdditional PersonalAccidentBenefits in termsofaThariyaBaruti DreadDiseaseandPersonalAccidentPolicy; (ii) paymentof themonthlypremiumsdue in termsof the ThariyaBarutiPukwanayaKganyaContract;and (iii) theEnhancedAncillaryBenefits. 6.3.3.2. Determinationofdiscounted transportationbenefit ZCCmay from time to time negotiatewith ServiceProviders to sellbus tickets tobe transported toand from Events. TheTrustmay in itsdiscretion,negotiatewith theZCC that itwillallow Members inGood Standing topurchase suchTicketsatDiscounted Prices, if theMember inGoodStandinghas purchaseda Leeto laMoriaReceipt. Inaccordancewith itsagreementwith the ServiceProvider, theZCC shallmakepayment to theServiceProvider equal to the ListPriceofall Tickets sold to themembersof theZCC. WhereMembers inGoodStandinghave purchasedaTicket , theTrustwill , in respectof suchMember inGoodStanding,pay the differencebetween theDiscountedPriceand the ListPrice to theZCC. Thepurchasepriceof the Leeto laMoria Receipt shallbe equal toR5.00 (Five Rand)per Leeto laMoriaReceipt. 6.3.3.3.1. Election to purchasea ticket AMember inGoodStanding mayelect topurchasea Leeto laMoriaReceipt,which Leeto laMoriaReceiptwillentitle theMember inGoodStanding tobuyaTicketat the DiscountedPriceona first- come, first-servedbasisonor after theCommencement Date, for the soleand exclusivepurposeof attending Events in the calendar year for which the Leeto laMoriaReceipt is bought. 6.3.3.3.2. and6.3.3.3.3. Election topurchasea ticket Members shallonlybeable tobuya Leeto laMoria Receipt in theevent that the ZCCmakes theTickets availableat theChurches. In theevent that theZCC makesavailable theTickets at theChurches, Member shallbeentitled topurchase a Leeto laMoriaReceiptand aTicket,at least21 (twenty- one)daysbeforeeachEvent, at theDiscountedPrice. 6.3.3.5.1. -6.3.3.5.3.Election topurchasea ticket AMember inGoodStanding, for purposesof the Leeto laMoria (DiscountedTransport) Benefits,meansaMember whohaspaida MembershipContribution ineachof the12 (twelve)Monthsprior to theMonth inwhich hewishes tobuya Leeto laMoriaReceipt. Leeto laMoriaReceiptswillonlybemade available toMemberswhoproduce their PaymentReceiptBookletsMembership Books reflecting that theyareMembers in GoodStanding. TicketsatDiscountedPriceswillbemade available toMembers inGoodStandingwho havepurchased Leeto laMoriaReceipts during the same calendar year inwhich the Event towhich theTicket relates Election to purchasea ticket EBRdoesnot make reference to this. 6.3.3.5.4. and6.3.3.5.5and6.3.3.4 Limitationof liability It isagreed that theTrust's liability for the Leeto laMoria (DiscountedTransport)Benefits shallbe limited topaying the differencebetween theDiscountedPriceand the ListPrice to theZCCas setout inAnnexeC.TheTrust shall innomanner be involved in respectof the services renderedby theService Provider,neither shall theTrustbe liable for such services. The contractual relationship for the services renderedpursuant to thepurchaseofaTicket, shallatall timesbebetween the Member inGoodStandingand theServiceProvider. Thenumber ofTicketsavailableper Eventat theDiscounted Pricewillbe limitedandwillbe soldbyChurchesonbehalfof theServiceProvider ona first- come, first- servedbasis. TheTrustwillnotbe liable in theevent thataMember inGood Standing isnotable tobuyaTicketataDiscountedPricedue to the fact thatno further Ticketsareavailable. Delegationand cession EBRdoesnot make reference to this. 6.3.3.4. Availabilityof tickets Thenumber ofTicketsavailableper Eventat theDiscountedPricewillbe limitedand willbe soldbyChurcheson behalfof theServiceProvider ona first come first servebasis. TheTrustwillnotbe liable in theevent thataMember inGoodStanding isnot able tobuyaTicketataDiscounted Pricedue to the fact thatno further Ticketsareavailable. Terminationof Regulations TheEBRs commencewith effect from the Commencement Dateand shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations.
