Provisionsof the existing FuneraryManagementRegulations ("FMRs") 3 of 4 2.Background TheFMRsare issued in termsof theMasterRegulationsand regulate the regulate theoptionalFuneraryManagement Servicesprocuredby theTrust. Importantprovisions Importantprovisionsnot included in theFMRs (a) 3.Commencement TheFMRs commencedon1April2021 4.Determination of funerary management regulations 5.Election to receive funerarymanagement services Subject to the terms, conditions,exceptionsand limitationsof these Regulationsa ServiceReceivermayelect to receiveFunerary Management Services:on thedeathof aQualifyingPerson;onorafter theCommencementDate. FuneraryManagement Services shallbeprovided to theService Receiveratnocost. 6. Limitation of liability FuneraryManagement Servicesareabenefit facilitatedby theTrust and the contractual relationshipwillaccordinglybebetween the ServiceReceiverand theServiceProvider. FuneraryManagement Services shallonlybeprovidedwhereaClaim is madewithin7 daysof dateofdeath. The liabilityof theTrust shallbe limited to facilitatingFunerary Management Services. Noperson shallhaveaClaim forFuneraryManagement Services except for-aBeneficiaryon thedeathof aMember inGoodStanding;a Member inGoodStandingon thedeathof aDependantwho predeceased suchMember. Thequalification requirements forFuneraryManagement Servicesand BurialBenefitsdifferandaccordingly theapprovalof Funerary Management Servicesby theTrust isnotand shallnotbeconstruedas theapprovalof aBurialBenefit. It is specificallyprovided that FuneraryManagement Services shallnot beprovided in respectof - paid-upDependants;miscarriages; miscarriages; stillbirths. 8.Claims AClaim forFuneraryManagement Servicesmustbemadeby the ServiceReceiver - withinaperiodof 7 (seven) daysafter theDateof Death;on thebasis setout inSchedule2. At the requestof theTrust, theServiceReceiver shallprovide itwith certified copiesororiginalsof thedocuments required inSchedule2. NoClaim shallbe consideredby theTrustunlessanduntil the documents specified inSchedule2 havebeenprovided to theTrust where theprovisionsof regulation8.2apply. 9.Determination ofdocumentation requiredandbasis for submitting claims TheTrust shall from time to timedetermine thedocumentation requiredand thebasis for submittingClaims. Anydeterminationby theTrust inaccordancewith regulation9.1 shall be set inSchedule2,asamended from time to timeand shall,on signatureby theTrust, formpartof theseRegulations in substitution foranyprevious Schedule2 witheffect from thedate specified in such amendmentor in theabsenceof suchdate, thedateof signatureby theTrust. The followingdocumentsmustbe in thepossessionof theService Receiverat the timeaClaim ismade - theoriginal identitydocument of theMember;and theMembershipBookof theMember. The followingdocumentationmustbe in thepossessionof theService Receiverat the timeaClaim ismade in the circumstances indicated: Where theQualifyingPerson isaDependant, thedocumentation required foraDependant inaccordancewith theBBRs.Where the Member isdeceased, theoriginal identitydocumentof theBeneficiary. 10.Amendments to the regulations TheRegulationsmaybeamended inwritingby theTrust in its sole discretionand suchamendments shallbe incorporated into the Regulationswitheffect from thedate specified in suchamendmentor in theabsenceof suchdate, thedateof signatureby theTrust. 11.Termination and regulations TheTrustmay terminate theseRegulations inwritingand shallgive noticeof the terminationdate ("theTerminationDate") viaPayPoints. . Notwithstanding theprovisionsof clause11. l, theseRegulations shall endure forpurposesof settlingallobligations includingbutnot being limited toprovidingFuneraryManagement Serviceswhichwere incurredonorbefore theTerminationDate. . 12.Delegation and Cession TheTrust shallbeentitled toandhasdelegated itsobligations in terms hereof toKIA togiveeffect to theseRegulations. TheMemberorBeneficiarymaynot cedeany rightsordelegateanyof itsobligations in termsof theseRegulations. Review of Changes to the Kganya Benefits Fund Trust Reasons formaterialdifferences a) Included toprovide for theapplicationof theConsumerProtectionAct (to theextentapplicable). *To the extentanydifferencesbetween theprovisionsof the existing Funerary ManagementRegulationsand the proposedEnhancedBenefitRegulationshavebeen identified thatdonotadversely affect the rightsof the members to theKganyaBenefitsFund Trust, such changeshavebeenmarked in orange in the corresponding cellsbelow. **To theextentany differencesbetween theprovisionsof theexisting FuneraryManagementRegulationsand theproposedEnhanced BenefitRegulationshavebeen identified thatdo adverselyaffect the rightsof the members to theKganyaBenefitsFund Trust, such changeshave beenmarked in red in the corresponding cellsbelow. ***Material differencesor changes indicated in red shading shallbeaccompanied by a letter referencing the material differenceor change in the leftmost column of the tableand the corresponding letter referencing suchmaterial difference or changewillbeaccompaniedbyanexplanation for the material differenceor change. ****Capitalised termsused in this comparison shallhave the meaning ascribed to them in the documents considered in this comparison,unless indicatedotherwise Provisionsof the EnhancedBenefitRegulations 3. Importantprovisions 3.1 To theextent that theConsumerProtectionActapplies to theseEnhancedBenefitsRegulations, theTrusthasaduty topoint out certain importantprovisions in theseEnhancedBenefits Regulations. Theclauseswhich contain these importantprovisions and reasonswhy theyare important are setoutbelow. 3.1.1 Limitationof risk, legal responsibilitiesand liability 3.1.1.1Regulation6.3.2.2.6, regulation6.3.3.4.2, regulation 6.3.3.5.2, regulation6.3.4.2.4and regulation6.3.5.2.6.are important because they limitandexcludeobligations, liabilities and legal responsibilities that theTrustandotherpersonsor entitiesmayotherwisehave toaMember. 3.1.1.2Asa resultof theseclauses,aMember's rightsand/or remediesagainst theTrustand theseotherpersonsandentities are limitedandexcluded.These clausesalso limitandexcludea Member's right to recoverormakeclaims for losses,damages, liabilityorharmaMemberorothersmay suffer. 3.1.2Assumptionsof risk, legal responsibilitiesand liabilityby Members 3.1.2.1Regulation6.2.3, regulation6.3.2.2.5, regulation6.3.4.2.3, regulation6.3.3.5.2 and regulation6.3.4.4.6 are important becauseaMember takeson risk, legal responsibilitiesand liability. Asa resultof these clauses,aMembermayalsobe responsible for claimsandotheramounts. AMemberwillalsobe responsible for, andaccepts, various risks,damages,harm,and injurywhichmay be sufferedbyaMemberandothers forwhat is stated in these clauses 5.Background TheEnhanced Benefits Regulations (" EBRs ")mustat all timesbe read with theMaster Regulations,and all termsand conditions setout in theMaster Regulationsapply to theEBRs. 4. Commencement 4.1 TheEBRs commencewith effect from the Commencement Dateand shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations. 4.2 TheEBRs replace in totality all regulations previously issued by theTrust dealingwith the samemattersas setoutherein, witheffect from the Commencement Date 6.1.and6.2.1 and6.3.4.3.Trust shall procurebenefits 6.1 TheTrust shallprocure certainEnhancedBenefits forallMembers who: (i) satisfy the requirements formembershipas setout in theMaster Regulations; (ii) havepaid theirMembershipContributions to theTrustas setout in theMasterRegulations;and (iii)qualifiesasaMember inGood Standing forpurposesof theEnhancedAncillaryBenefits. 6.1.2TheTrust shallprocure suchbenefitsusing itsbest endeavours in linewith theFinancialSectorCharter. 6.2 The followingbenefitswillbeprocuredand/orprovided toMembers: (i) access to theThari yaBarutiPukwana yaKganyaContract for the provisionof insurance coverand funeral (burial)benefitsandAdditional FuneralBenefits in termsofaThari yaBarutiFuneralPolicyand insurance coveranddreaddiseasebenefits,personalaccidentbenefitsand AdditionalPersonalAccidentBenefits in termsofaThari yaBarutiDread DiseaseandPersonalAccidentPolicy; (ii) paymentof themonthly premiumsdue in termsof theThariyaBarutiPukwana yaKganya Contract;and (iii) theEnhancedAncillaryBenefits. 6.3.4.3.1 TheTrust shallonlyprovide theFuneraryManagementBenefits setout in regulation6.3.4.2 above in respectof thedeathaQualifying Person if the relevantCMember, isaMember inGoodStandingby virtue of –paymentof aMembershipContributionwithaDateof Payment in theMonthpreceding theMonth inwhich theDateofDeathoccurred;or paymentof aMembershipContributionwithaDateof Payment in the Month inwhich theDateof Deathoccurred,provided that theDateof Payment isprior to theDateof Death. 6.3.4.2.1.,6.3.4.2.2.andAnnexeDDeterminationof funerary management regulations 6.3.4.2.1. - TheTrustmay from time to timeprocure theFuneraryManagementBenefits from theServiceProvider forallMembers inGoodStandingon thedeathof aQualifyingPerson. 6.3.4.2.2. - TheFuneraryManagementBenefitsentitlesallMembers inGoodStanding to the benefitsas setbelowand isamended from time to timeby theTrust. AnnexeD - Subject to the termsand conditionsof theEBRs, theTrustmay from time to time procure theFuneraryManagementBenefits from theServiceProvider forallMembers inGood Standingon thedeathof aQualifyingPersonon the termsand conditions setout inAnnexeD. Where theQualifyingPersondiedand themortal remainsarewithin theTerritory;andaClaim submittedbya ServicesReceiver in respectofaQualifyingPersonareapprovedby theTrust, theServiceProvider shall: repatriate themortal remains toa funeralhomeclosest to theplace of burial,which funeralhome shallbe chosenby theServiceReceiveron condition that the distancebetween the locationof themortal remainsand thenominated funeralhome is in excessof100km.Repatriationapplies tobothnational repatriationand repatriation toand from the followingAfrican countries,namely SouthAfrica,Namibia,Zimbabwe,Botswana, Swaziland, Lesotho,Mozambiqueand suchotherAfrican countriesbelow the22nddegree parallelandassist theServiceReceiver inarranging the funeral,obtainingadeath certificate, storageof themortal remains,and, if requested,by theServiceReceiverarranginganautopsy and/or referral toapathologist andobtaining legalassistance relating to theQualifying Person’swillorestate. TheTrust shall procureand/ormaintain access to anafterhours call centremannedbetween thehoursof16:30 and08:00of the following day aswell asweekendsandpublicholidays toensurea24-hourhelpline facility forServiceReceivers.This call centrewill only receive calls relating to FuneraryManagementServices. Election to receive funerary management services E BRdoesnot make reference to this. 6.3.4.2.3.Election to receive funerary management services Any costsover andabove the limits stipulated in AnnexeD willbe for thecostof the relevant Service Receiver. 6.3.4.2.4.Limitation of liability TheTrust's liability for theFunerary ManagementBenefits shallbe limited to procuring the services from theService Provideras setout in AnnexeD.TheTrust shall innomannerbe involved in respectof the services renderedby theServiceProvider, neither shall theTrust be liable for such services.The contractual relationship for the services rendered, shallatall timesbebetween the ServiceReceiverand the ServiceProvider. AnnexeE. Limitation of liability AClaim for Funerary Management Benefitsmustbe madebya Service Receiverwithina periodof 7 (seven)daysafter theDateof Death. 6.3.4.5.1.and 6.3.4.5.2. Limitation of liability Noperson shall haveaClaim for Funerary Management Servicesexcept for a ServiceReceiver. It is specifically provided that Funerary Management Benefits shallnot beprovided in respectof– aDependantChild who survives the Member inGood Standing; miscarriages; abortions;and Stillbirths. Limitation of liability EBRdoesnot make reference to this. 3.Termination and regulations TheEBRs commencewith effect from the Commencement Dateand shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations Termination and regulations EBRdoesnot make reference to this. Delegation and Cession EBRdoesnot make reference to this. Delegation and Cession EBRdoesnot make reference to this. TheTrustmayprocure theFuneraryManagement Services from the ServiceProvider forServiceReceivers.TheFuneraryManagement Servicesmaybeamended,on signatureby theTrust.Thebenefits currently include the following,whichmaybeamended.Where the QualifyingPersondiedand themortal remainsarewithin theTerritory; andaClaim submittedbya ServicesReceiver in respectof aQualifying Personareapprovedby theTrust, theServiceProvider shall: repatriate themortal remains toa funeralhome inSouthAfrica closest to the placeof burial,which funeralhome shallbe chosenby theService Receiveron condition that thedistancebetween the locationof the mortal remainsand thenominated funeralhome is inexcessof 100km. Repatriationapplies tobothNationaland International repatriation andassist theServiceReceiver inarranging the funeral,obtaininga death certificate, storageof themortal remains,arranginganautopsy and/or referral toapathologist andobtaining legalassistance relating to theQualifyingPerson’swillorestate. TheServiceProvider shallmaintainanafterhours call centremanned between thehoursof16:30and08:00of the followingdayaswellas weekendsandpublicholidays toensurea24 hourhelpline facility for ServiceReceivers.This call centrewillonly receivecalls relating to FuneraryManagement Services. AnnexeE.Claims A claimmustbe madewithin7 (seven)daysafter theDateof Death. AnnexeE.Claims At the requestof theTrust,a ServiceReceiver shallprovide the Trustwith certified copiesor originalsof the documents required fora Claim for Funerary Management Benefits. AnnexeE.Claims NoClaim shallbe consideredby the Trustunlessand until the documents specifiedbelow havebeen provided to the Trustand/or the Administratoron behalf of the Trust. AnnexeE.Determination ofdocumentation required and basis for submitting claims NoClaim shallbe consideredby theTrustunlessand until thedocuments specifiedbelowhavebeenprovided to theTrustand/or theAdministratoronbehalf of the Trust (theoriginal identitydocumentof theMember in GoodStanding;and thePaymentReceiptBooklet of the Member inGoodStanding). Where theQualifyingPerson isaDependantChild, the followingdocuments (theoriginal identitydocument and/orbirth certificateof theDependantChild). WhereaDependantChild isover theageof 25 (twenty fiveyears) proof that suchDependantChild isorwould bepermanentlydependenton theMemberbecauseof mentaland/orphysicaldisability (amarriage certificate, adoption certificateorotherproof sufficient to show that DependantChildwho isadoptedordoesnothave the same surnameas theMember inGoodStandingwas a DependantChild; andanyotherdocuments requiredby theTrust todetermine thatapersonqualifiesasa DependantChild forpurposesof theFunerary ManagementBenefit). Where theMember inGoodStanding isdeceased, the followingdocuments (theoriginal identitydocumentof theServiceReceiver.At the requestof theTrust,a ServiceReceiver shallprovide theTrustwith certified copiesororiginalsof thedocuments required foraClaim forFuneraryManagementBenefits.) Amendments to the regulations EBRdoesnot make reference to this.
