Provisionsof theexisting FuneraryManagementRegulations ("FMRs") 3of3 2.Background TheFMRsare issued in termsof theMasterRegulationsand regulate the regulate theoptionalFuneraryManagementServicesprocuredby theTrust. Importantprovisions Importantprovisionsnot included in theFMRs (a) 3.Commencement TheFMRs commencedon1April2021 4.Determinationof funerarymanagement regulations 5.Election to receive funerarymanagement services Subject to the terms, conditions,exceptionsand limitationsof these Regulationsa ServiceReceivermayelect to receiveFunerary ManagementServices:on thedeathofaQualifyingPerson;onorafter theCommencementDate. FuneraryManagementServices shallbeprovided to theService Receiveratnocost. 6.Limitationof liability FuneraryManagementServicesareabenefit facilitatedby theTrustand thecontractual relationshipwillaccordinglybebetween theService Receiverand theServiceProvider. FuneraryManagementServices shallonlybeprovidedwhereaClaim is madewithin7daysofdateofdeath. The liabilityof theTrust shallbe limited to facilitating Funerary ManagementServices. Noperson shallhaveaClaim forFuneraryManagementServicesexcept for-aBeneficiaryon thedeathofaMember inGoodStanding;a Member inGoodStandingon thedeathofaDependantwho predeceased suchMember. Thequalification requirements forFuneraryManagementServicesand BurialBenefitsdifferandaccordingly theapprovalofFunerary ManagementServicesby theTrust isnotand shallnotbeconstruedas theapprovalofaBurialBenefit. It is specificallyprovided thatFuneraryManagementServices shallnot beprovided in respectof -paid-upDependants;miscarriages; miscarriages; stillbirths. 8.Claims AClaim for FuneraryManagementServicesmustbemadeby the ServiceReceiver -withinaperiodof7 (seven)daysafter theDateof Death;on thebasis setout inSchedule2. At the requestof theTrust, theServiceReceiver shallprovide itwith certified copiesororiginalsof thedocuments required inSchedule2. NoClaim shallbeconsideredby theTrustunlessanduntil the documents specified inSchedule2havebeenprovided to theTrust where theprovisionsof regulation8.2apply. 9.Determinationofdocumentation requiredandbasis for submitting claims TheTrust shall from time to timedetermine thedocumentation requiredand thebasis for submittingClaims. Anydeterminationby theTrust inaccordancewith regulation9.1 shall be set inSchedule2,asamended from time to timeand shall,on signatureby theTrust, formpaidof theseRegulations in substitution for anypreviousSchedule2witheffect from thedate specified in such amendmentor in theabsenceof suchdate, thedateof signatureby the Trust. The followingdocumentsmustbe in thepossessionof theService Receiverat the timeaClaim ismade - theoriginal identitydocumentof theMember;and theMembershipBookof theMember. The followingdocumentationmustbe in thepossessionof theService Receiverat the timeaClaim ismade in thecircumstances indicated: Where theQualifyingPerson isaDependant, thedocumentation required foraDependant inaccordancewith theBBRs.Where the Member isdeceased, theoriginal identitydocumentof theBeneficiary. 10.Amendments to the regulations TheRegulationsmaybeamended inwritingby theTrust in its sole discretionand suchamendments shallbe incorporated into the Regulationswitheffect from thedate specified in suchamendmentor in theabsenceof suchdate, thedateof signatureby theTrust. 11.Terminationand regulations TheTrustmay terminate theseRegulations inwritingand shallgive noticeof the terminationdate ("theTerminationDate")viaPayPoints. . Notwithstanding theprovisionsofclause11. l, theseRegulations shall endure forpurposesof settlingallobligations includingbutnotbeing limited toproviding FuneraryManagementServiceswhichwere incurredonorbefore theTerminationDate. . 12.DelegationandCession TheTrust shallbeentitled toandhasdelegated itsobligations in terms hereof toKIA togiveeffect to theseRegulations. TheMemberorBeneficiarymaynot cedeany rightsordelegateanyof itsobligations in termsof theseRegulations. Provisionsof theBasicBenefitRegulations Review of Changes to the Kganya Benefits Fund Trust Reasons formaterialdifferences a) Included toprovide for theapplicationof theConsumerProtectionAct (to theextentapplicable). *To theextentanydifferencesbetween theprovisionsof theexisting FuneraryManagementRegulationsand theproposedBasicBenefitRegulationshavebeen identified thatdonotadverselyaffect the rightsof themembers to theKganyaBenefitsFundTrust, such changeshavebeenmarked inorange in the corresponding cellsbelow. **To theextentanydifferencesbetween theprovisionsof theexisting FuneraryManagementRegulationsand theproposedBasicBenefitRegulationshavebeen identified thatdoadverselyaffect the rightsof themembers to theKganyaBenefitsFundTrust, such changeshavebeenmarked in red in the corresponding cellsbelow. ***Materialdifferencesor changes indicated in red shading shallbeaccompaniedbya letter referencing thematerialdifferenceor change in the leftmost columnof the tableand the corresponding letter referencing suchmaterialdifferenceor changewillbeaccompaniedbyanexplanation for thematerialdifferenceor change. ****Capitalised termsused in this comparison shallhave themeaningascribed to them in thedocuments considered in this comparison,unless indicatedotherwise 3. Importantprovisions 3.1To theextent that theConsumerProtectionActapplies to theseBasicBenefit Regulations, theTrusthasaduty topointout certain importantprovisions in these BasicBenefitsRegulations. The clauseswhich contain these importantprovisionsand reasonswhy theyare importantare setoutbelow. 3.1.1 Limitationof risk, legal responsibilitiesand liability 3.1.1.1Regulation6.3.2.2.6, regulation6.3.3.4.2, regulation6.3.3.5.4and regulation 6.3.4.2.4are importantbecause they limitandexcludeobligations, liabilitiesand legal responsibilities that theTrustandotherpersonsorentitiesmayotherwisehave toa Member. 3.1.1.2Asa resultof theseclauses,aMember's rightsand/or remediesagainst the Trustand theseotherpersonsandentitiesare limitedandexcluded.Theseclauses also limitandexcludeaMember's right to recoverormakeclaims for losses, damages, liabilityorharmaMemberorothersmay suffer. 3.1.2AssumpƟonsof risk, legal responsibiliƟesand liabilitybyMembers 3.1.2.1Regulation6.2.3, regulation6.3.2.2.5, regulation6.3.3.5.4, regulation 6.3.4.2.4and regulation6.3.4.4.6are importantbecauseaMember takeson risk, legal responsibilitiesand liability.Asa resultof theseclauses,aMembermayalsobe responsible for claimsandotheramounts. AMemberwillalsobe responsible for,and accepts, various risks,damages,harm,and injurywhichmaybe sufferedbya Memberandothers forwhat is stated in theseclauses 5.Background TheBasicBenefits Regulations (" BBRs ") mustatall timesbe readwith the MasterRegulations, andall termsand conditions setout in theMaster Regulationsapply to theBBRs. 4.Commencement 4.1TheBBRs commencewith effect from the CommencementDateand shall endureuntil terminatedby the Trust inaccordancewith the MasterRegulations. 4.2TheBBRs replace in totality allRegulationspreviously issuedby theTrustdealingwith the samemattersas setout herein,witheffect from the CommencementDate 6.1.and6.2.1and6.3.4.3.Trust shallprocurebenefits 6.1TheTrust shallprocurecertainbasicbenefits for thoseMemberswho: (i) satisfy the requirements formembershipas setout in theMasterRegulations; (ii)havepaid theirMembershipContributions to theTrustas setout in theMasterRegulations;and (iii)qualifiesasaMember inGoodStanding forpurposesof theBasicAncillary Benefits. 6.1.2TheTrust shallprocure suchbenefitsusing itsbestendeavours in linewith the FinancialSectorCharter. 6.2The followingbenefitswillbeprocuredand/orprovided: (i)access to thePukwana yaKganyaContract for theprovisionof insurancecoverand funeral (burial)benefits in termsofa FuneralPolicyand insurancecoveranddreaddiseaseandpersonal accidentbenefits in termsofaDreadDiseaseandPersonalAccidentPolicy; (ii) paymentof themonthlypremiumsdue in termsof thePukwana yaKganyaContract; and (iii) theBasicAncillaryBenefits. 6.3.4.3.1TheTrust shallonlyprovide theFuneraryManagementBenefits setout in regulation6.3.4.2above in respectof thedeathaQualifyingPerson if the relevant Member , isaMember inGoodStandingbyvirtueof–paymentofaMembership ContributionwithaDateofPayment in theMonthpreceding theMonth inwhich the DateofDeathoccurred;orpaymentofaMembershipContributionwithaDateof Payment in theMonth inwhich theDateofDeathoccurred,provided that theDateof Payment isprior to theDateofDeath. 6.3.4.2.1.,6.3.4.2.2.andAnnexeDDeterminationof funerarymanagement regulations 6.3.4.2.1. -TheTrustmay from time to timeprocure theFuneraryManagement Benefits from theServiceProvider forallMembers inGoodStandingon thedeathofa QualifyingPerson. 6.3.4.2.2. -TheFuneraryManagementBenefitsentitlesallMembers inGood Standing to thebenefitsas setbelowand isamended from time to timeby theTrust. AnnexeD -Subject to the termsand conditionsof theBBRs, theTrustmay from time to timeprocure theFuneraryManagementBenefits from theServiceProvider forall Members inGoodStandingon thedeathofaQualifyingPersonon the termsand conditions setout inAnnexeD.Where theQualifyingPersondiedand themortal remainsarewithin theTerritory;andaClaim submittedbya ServicesReceiver in respectof thedeathofaQualifyingPersonareapprovedby theTrust, theService Provider shall: repatriate themortal remains toa funeralhome closest to theplaceof burial,which funeralhome shallbechosenby theServiceReceiveron condition that thedistancebetween the locationof themortal remainsand thenominated funeral home is inexcessof100km.Repatriationapplies tobothnational repatriationand repatriation toand from the followingAfrican countries,namelySouthAfrica, Namibia, Zimbabwe,Botswana, Swaziland, Lesotho,Mozambiqueand suchother African countriesbelow the22nddegreeparallelandassist theServiceReceiver in arranging the funeral,obtainingadeath certificate, storageof themortal remains, and, if requested,by theServiceReceiverarranginganautopsyand/or referral toa pathologistandobtaining legalassistance relating to theQualifyingPerson’swillor estate. Election to receive funerary management services BBRdoesnot make reference to this. 6.3.4.2.3.Election to receive funerary management services Any costsover andabove the limits stipulated in AnnexeDwillbe for thecostof the relevantService Receiver. 6.3.4.2.4.Limitationof liability TheTrust's liability for theFunerary ManagementBenefits shallbe limited toprocuring the services from the ServiceProvideras setout inAnnexe D.TheTrust shall innomannerbe involved in respectof the services renderedby theServiceProvider, neither shall theTrustbe liable for such services.Thecontractual relationship for the services rendered, shallatall timesbebetween the ServiceReceiverand theService Provider. AnnexeE. Limitationof liability AClaim for Funerary Management Benefitsmustbe madebya Service Receiverwithina periodof7 (seven)daysafter theDateofDeath. 6.3.4.5.1.and6.3.4.5.2. Limitationof liability Noperson shallhaveaClaim forFuneraryManagement Servicesexcept fora Service Receiver. It is specificallyprovided that FuneraryManagement Benefits shallnotbeprovided in respectof– aDependantChildwho survives theMember inGood Standing; miscarriages;abortions;and Stillbirths. Limitationof liability BBRdoesnot make reference to this. AnnexeE.Claims A claimmustbe madewithin7 (seven)daysafter theDateofDeath. Terminationand regulations BBRdoesnot make reference to this. AnnexeE.Claims At the requestof theTrust,a ServiceReceiver shallprovide the Trustwith certified copiesor originalsof the documents required fora Claim for Funerary Management Benefits. AnnexeE.Claims NoClaim shallbe consideredby the Trustunlessand until the documents specifiedbelow havebeen provided to the Trustand/or the Administratoron behalfof the Trust. AnnexeE.Determinationofdocumentation requiredandbasis for submitting claims NoClaim shallbeconsideredby theTrustunlessanduntil thedocuments specified belowhavebeenprovided to theTrustand/or theAdministratoronbehalfof the Trust (theoriginal identitydocumentof theMember inGoodStanding;and the PaymentReceiptBookletof theMember inGoodStanding). Where theQualifyingPerson isaDependantChild, the followingdocuments (the original identitydocumentand/orbirth certificateof theDependantChild). WhereaDependantChild isover theageof25 (twenty fiveyears)proof that such DependantChild isorwouldbepermanentlydependenton theMemberbecauseof mentaland/orphysicaldisability (amarriagecertificate,adoption certificateorother proof sufficient to show thatDependantChildwho isadoptedordoesnothave the same surnameas theMember inGoodStandingwasaDependantChild; andany otherdocuments requiredby theTrust todetermine thatapersonqualifiesasa DependantChild forpurposesof theFuneraryManagementBenefit). Where theMember inGoodStanding isdeceased, the followingdocuments (the original identitydocumentof theServiceReceiver.At the requestof theTrust,a ServiceReceiver shallprovide theTrustwith certified copiesororiginalsof the documents required foraClaim for FuneraryManagementBenefits.) Amendments to the regulations BBRdoesnot make reference to this. 3.Termination and regulations TheBBRs commencewith effect from the Commencement Dateand shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations TheTrustmayprocure theFuneraryManagementServices from the ServiceProvider forServiceReceivers.TheFuneraryManagement Servicesmaybeamended,on signatureby theTrust.Thebenefits currently include the following,whichmaybeamended.Where the QualifyingPersondiedand themortal remainsarewithin theTerritory; andaClaim submittedbya ServicesReceiver in respectofaQualifying Personareapprovedby theTrust, theServiceProvider shall: repatriate themortal remains toa funeralhome inSouthAfrica closest to theplace ofburial,which funeralhome shallbechosenby theServiceReceiveron condition that thedistancebetween the locationof themortal remains and thenominated funeralhome is inexcessof100km.Repatriation applies tobothNationaland International repatriationandassist the ServiceReceiver inarranging the funeral,obtainingadeath certificate, storageof themortal remains,arranginganautopsyand/or referral toa pathologistandobtaining legalassistance relating to theQualifying Person’swillorestate. TheServiceProvider shallmaintainanafterhours call centremanned between thehoursof16:30and08:00of the followingdayaswellas weekendsandpublicholidays toensurea24hourhelpline facility for ServiceReceivers.This call centrewillonly receivecalls relating to FuneraryManagementServices.
