Provisionsof the existing Leeto LaMoria (DiscountedTransportation Services) Regulations ("LLMRs") 2 of 3 2.Background The LLMRsare issued in termsof the MasterRegulationsand regulate the discounted transportation services. Importantprovisions Importantprovisionsnot included in the LLMRs (a) 3.Commencement The LLMRs commencedon1 April2021 4.Determination ofdiscounted transportation benefit TheZCCmaynegotiatewithService Provider(s) toprovide theDiscounted TransportationBenefit. Subject to the termsand conditionsof the LLMRs, theDiscountedTransportation Benefitentitlesall LoyalMemberswho havepurchasedaCurrent Leeto laMoria Receipt topurchase1 (one)Discounted Ticket perEventheldduring the same calendar year inwhich theaforementioned receiptwaspurchased from theService Providerat the ListPrice less50% (fifty percent) for the soleandexclusivepurpose of attendinganEvent. Thepurchasepriceof theCurrent Leeto la MoriaReceipt shallbeequal to R5.00 (FiveRand) per receipt 5.Election topurchase a ticket Subject to the terms, conditions,exceptions and limitationsof the LLMRsa Loyal Membermayelect topurchaseaCurrent Leeto laMoriaReceiptand thereaftera Ticket at theDiscountedPriceonorafter theCommencementDate for the soleand exclusivepurposeof attendinganEvent. TheZCCwillarrange thatChurches,on behalf of theServiceProvider,makes the Ticketsavailable forpurchasebya Loyal MemberwhohaspurchasedaCurrent Leeto laMoriaReceiptat least21 (twenty one) daysbeforeeachEventat the DiscountedPrice. TicketsatDiscountedPriceswillonlybe sold toMemberswhoproduce their MembershipBooks reflecting that theyare LoyalMembersand that theyhave purchasedCurrent Leeto laMoriaReceipts during the samecalendaryear inwhich the Event towhich theTicket relateswillbe held. 6. Limitation of liability TheDiscountedTransportationBenefit isa benefitprocuredby theTrustand accordingly - no contractual relationshipexistsbetween theTrustand theServiceReceiver; the Ticket ispurchasedby theServiceReceiver in termsofanagreemententered intowith theServiceProvider. TicketsatDiscountedPricesandmealsare madeavailable to LoyalMembersonly.The numberof TicketsavailableperEventat the DiscountedPricewillbe limitedandwillbe soldbyChurchesonbehalfof theService Providerona first come first servebasis. 7.Amendments to theRegulations TheRegulationsmaybeamended inwriting by theTrust in its solediscretionand such amendments shallbe incorporated into the Regulationswitheffect from thedate specified in suchamendmentor in the absenceof suchdate, thedateof signature by theTrust. 8.Termination ofRegulations TheTrustmay terminate theseRegulations inwritingand shallgivenoticeof the terminationdateviaPayPoints. 9.Delegation and cession TheTrust shallbeentitled toappoint oneor moreadministrators toperform administration services inorder togive effect to theseRegulations. TheMembermaynot cedeany rightsor delegateanyof itsobligations in termsof theseRegulations. TheDiscountedTransportationBenefit may notbeceded,assignedor otherwisepledgedas security. Review of Changes to the Kganya Benefits Fund Trust Reasons formaterialdifferences a) Included toprovide for theapplicationof theConsumerProtectionAct (to theextentapplicable). *To the extentanydifferencesbetween theprovisionsof the existing Leeto LaMoria (DiscountedTransportationServices)Regulationsand theproposed BasicBenefitRegulationshavebeen identified thatdonotadverselyaffect the rightsof the members to theKganyaBenefitsFund Trust, such changeshavebeenmarked in orange in the corresponding cellsbelow. **To theextentany differencesbetween theprovisionsof theexisting Leeto LaMoria (DiscountedTransportation Services)Regulationsand the proposed BasicBenefitRegulationshave been identified thatdo adverselyaffect the rightsof the members to theKganyaBenefitsFund Trust, such changeshavebeenmarked in red in the corresponding cellsbelow. ***Material differencesor changes indicated in red shading shallbeaccompanied by a letter referencing the material differenceor change in the leftmost column of the tableand the corresponding letter referencing suchmaterial difference or changewillbeaccompaniedbyanexplanation for the material differenceor change. ****Capitalised termsused in this comparison shallhave the meaning ascribed to them in the documents considered in this comparison,unless indicatedotherwise Provisionsof the BasicBenefitRegulations 3. Importantprovisions 3.1 To theextent that theConsumerProtectionActapplies to theseBasic BenefitsRegulations, theTrusthasaduty topointout certain important provisions in theseBasicBenefitsRegulations. Theclauseswhich contain these important provisionsand reasonswhy theyare important are setoutbelow. 3.1.1 Limitationof risk, legal responsibilitiesand liability 3.1.1.1Regulation6.3.2.2.6, regulation6.3.3.4.2, regulation6.3.3.5.4 and regulation6.3.4.2.4 are importantbecause they limitandexcludeobligations, liabilitiesand legal responsibilities that theTrust andotherpersonsorentities mayotherwisehave toaMember. 3.1.1.2Asa resultof theseclauses,aMember's rightsand/or remediesagainst theTrustand theseotherpersonsandentitiesare limitedandexcluded.These clausesalso limitandexcludeaMember's right to recoverormakeclaims for losses,damages, liabilityorharmaMemberorothersmay suffer. 3.1.2AssumpƟonsof risk, legal responsibiliƟesand liabilitybyMembers 3.1.2.1Regulation6.2.3, regulation6.3.2.2.5, regulation6.3.3.5.4, regulation 6.3.4.2.4 and regulation6.3.4.4.6 are importantbecauseaMember takeson risk, legal responsibilitiesand liability.Asa resultof these clauses,aMember mayalsobe responsible for claimsandotheramounts. AMemberwillalsobe responsible for,andaccepts, various risks,damages,harm,and injurywhichmay be sufferedbyaMemberandothers forwhat is stated in these clauses 5.Master Regulations TheBasicBenefits Regulations (" BBRs ")mustat all timesbe read with theMaster Regulations,andall termsand conditions setout in theMaster Regulationsapply to theBBRs. 4.Commencement 4.1 TheBBRs commence witheffect from the CommencementDate and shallendureuntil terminatedby theTrust inaccordancewith the MasterRegulations. 4.2 TheBBRs replace in totalityallRegulations previously issuedby the Trustdealingwith the samemattersas setout herein,witheffect from theCommencementDate 6.1.and6.2.1 Trust shallprocurebenefits 6.1 TheTrust shallprocure certainbasicbenefits for those Memberswho: (i) satisfy the requirements formembership as setout in theMasterRegulations; (ii)havepaid their MembershipContributions to theTrustas setout in the MasterRegulations;and (iii) qualifiesasaMember inGood Standing forpurposesof theBasicAncillaryBenefits. 6.1.2TheTrust shallprocure suchbenefitsusing itsbest endeavours in linewith theFinancialSectorCharter. 6.2 The followingbenefitswillbeprocuredand/orprovided: (i) access to thePukwana yaKganyaContract for the provisionof insurance coverand funeral (burial)benefits in termsof aFuneralPolicyand insurancecoveranddread diseaseandpersonalaccidentbenefits in termsof aDread DiseaseandPersonalAccidentPolicy; (ii) paymentof the monthlypremiumsdue in termsof thePukwana yaKganya Contract;and (iii) theBasicAncillaryBenefits. 6.3.3.2.Determination ofdiscounted transportationbenefit ZCCmay from time to timenegotiatewithServiceProviders to sellbus tickets tobe transported toand fromEvents. TheTrustmay in itsdiscretion,negotiatewith theZCC that it willallowMembers inGoodStanding topurchase such TicketsatDiscountedPrices, if theMember inGoodStanding haspurchaseda Leeto laMoriaReceipt. Inaccordancewith itsagreementwith theServiceProvider, theZCC shallmakepayment to theServicesProviderequal to theListPriceof allTickets sold to themembersof theZCC. WhereMembers inGoodStandinghavepurchasedaTicket , theTrustwill in respectof suchMember inGoodStanding, pay thedifferencebetween theDiscountedPriceand the List Price to theZCC. AnnexeC.Determination ofdiscounted transportation benefit Subject to the termsand conditionsof the BBRs, theDiscountedTransportationBenefit entitlesallMembers inGoodStandingwho havepurchaseda Leeto laMoriaReceipt to purchase1 DiscountedTicket perEvent ,ona first-come, first-servedbasis,heldduring the samecalendaryear inwhich the aforementioned receiptwaspurchased from theServiceProviderat the ListPrice less50% (fiftypercent) for the soleandexclusive purposeof attendinganEvent. Thepurchasepriceof the Leeto laMoria Receipt shallbeequal toR5.00 (FiveRand) per Leeto laMoriaReceiptandmustbepaid in the manner setout in theMasterRegulations. 6.3.3.3.1.Election to purchasea ticket AMember inGood Standingmayelect to purchasea Leeto laMoria Receipt,which Leeto la MoriaReceiptwillentitle theMember inGood Standing tobuyaTicket at theDiscountedPriceona first come first servedbasis onorafter the CommencementDate, for the soleandexclusive purposeof attendingan Event in thecalendaryear forwhich the Leeto la MoriaReceipt isbought. 6.3.3.3.2.and 6.3.3.3.3. Election topurchasea ticket Members shallonlybeable tobuya Leeto laMoria Receipt in theevent that the ZCCmakes theTickets availableat theChurches. In theevent that theZCC makesavailable theTickets at theChurches,aMember shallbeentitled topurchase a Leeto laMoriaReceiptand aTicket,at least21 (twenty- one) daysbeforeeachEvent, at theDiscountedPrice. 6.3.3.5.1. - 6.3.3.5.3.Election topurchasea ticket AMember inGoodStanding, forpurposesof the Leeto laMoria (DiscountedTransport) Benefits, meansaMemberwhohaspaidaMembership Contribution ineachof the12 (twelve) Months prior to theMonth inwhichhe/shewishes tobuy a Leeto laMoriaReceipt. Leeto laMoriaReceiptswillonlybemade available toMemberswhoproduce theirPayment ReceiptBookletsMembershipBooks reflecting that theyareMembers inGoodStanding. TicketsatDiscountedPriceswillbemadeavailable toMembers inGoodStandingwhohave purchased Leeto laMoriaReceiptsduring the samecalendaryear inwhich theEvent towhich theTicket relates Election to purchasea ticket BBRdoesnot make reference to this. 6.3.3.5.4.and 6.3.3.5.5and 6.3.3.4 Limitation of liability It isagreed that theTrust's liability for the Leeto laMoria (DiscountedTransport) Benefits shallbe limited topaying the differencebetween theDiscountedPriceand the ListPrice to theZCCas set out inAnnexeC.TheTrust shall innomannerbe involved in respectof the services renderedby theService Provider,neither shall theTrust be liable for such services. The contractual relationship for the services renderedpursuant to thepurchaseof aTicket, shallatall timesbebetween the Member inGoodStandingand theServiceProvider. Thenumberof TicketsavailableperEventat theDiscounted Pricewillbe limitedandwillbe soldbyChurchesonbehalf of theServiceProviderona first- come, first- servedbasis. TheTrustwillnot be liable in theevent thataMember inGood Standing isnot able tobuyaTicketataDiscountedPricedue to the fact thatno furtherTicketsareavailable. Delegation and cession BBRdoesnot make reference to this. 6.3.3.4.Availabilityof tickets Thenumberof Ticketsavailable perEventat theDiscountedPrice willbe limitedandwillbe soldby Churchesonbehalfof theService Providerona first come first serve basis. TheTrustwillnot be liable in the event thataMember inGood Standing isnot able tobuya Ticket ataDiscountedPricedue to the fact thatno furtherTickets areavailable. The Leeto laMoria (Discounted Transport)Benefitsareavailable only forMembersandnotalso for theirdependent children Amendments to theRegulations BBRdoesnot make reference to this. Termination of Regulations TheBBRs commencewith effect from the Commencement Dateand shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations.
