Provisionsof theexistingRoadsideAssistance Regulations ("RARs") 1of3 2. Background TheRARsare issued in termsof theMaster Regulationsand regulate RoadSide Assistance procuredby theTrust. Importantprovisions Importantprovisionsnot included in theRARs (a) 3. Commencement TheRARs commencedon1April2021. 4. Road sideassistancebenefit TheTrustmayprocure theRoadsideAssistance Benefit from theServiceProvider for allMembers in GoodStanding,applicable for theperiod7days before,duringand7daysafter eachEventheldatZion CityMoriaduringEaster,September andDecember eachyear only. Members inGoodStandinghaveaccess to the certain services (Flatbattery - jump start,Flat tyre (helpwith changeof tyre),Keys locked inMotor Vehicle (unlockingonly),Fuelassistance (limited to five litres per incident),Minor roadside-running repairs (electrical, coil, immobilizer etc.),or transmissionof urgentmessages.) in theeventofa roadside emergency (limitedup toR2000 (incl.VAT)per incident).Tow-in service (limited toR3000 (incl.VAT) to thenearestapproveddealership (ifunder warranty), repair centreor panelbeater in theeventof mechanicalor electricalbreakdownor accident damage. TheRoadsideAssistanceBenefitwill,whenever applicable,beavailable to theMembers inGood Standing for thedurationof their Journey,provided that suchbenefit shallonlybeavailable in respectof JourneysundertakenbyaMember inGoodStanding within theperiod commencingonadate7daysprior toanEventand enduringuntiladate7daysafter the Event. Members requiring theRoadside AssistanceBenefit should contact theKganyaHelp Line. TheRoadsideAssistanceBenefit isonlyavailable within thebordersofSouthAfrica. TheRoadsideAssistanceBenefitwillonlybe made available toMembers inGoodStanding in relation toa Motor Vehicle. Any costsover andabove the limits stipulated in Schedule1 relating to theprovisionof theRoadside AssistanceBenefitwillbe for the costof the relevant Member inGoodStanding. 5. LimitationofLiability TheRoadsideAssistanceBenefit isabenefitprocured by theTrustand the contractual relationshipwill accordinglybe between theMember inGoodStanding and theServiceProvider. 6. Amendments to theRegulations TheRegulationsmaybeamended inwritingby the Trust in its solediscretionand suchamendments shall be incorporated into theRegulationswitheffect from thedate specified in suchamendmentor in the absenceof suchdate, thedateof signatureby the Trust. 7. Termination TheTrustmay terminate theseRegulations inwriting and shallgivenoticeof the terminationdateviaPay Points. 8. Delegationand cession TheTrust shallbe entitled toappointoneor more administrators toperform administration services in order togiveeffect to theRARs. TheMember maynot cedeany rightsor delegateany of itsobligations in termsof theseRegulations. TheRoadsideAssistanceBenefitmaynotbe ceded, assignedor otherwisepledgedas security. Review of Changes to the Kganya Benefits Fund Trust *To theextentanydifferencesbetween theprovisionsof theexistingRoadsideAssistanceRegulationsand theproposedBasicBenefitRegulationshavebeen identified thatdonotadverselyaffect the rightsof themembers to theKganyaBenefitsFundTrust, such changeshavebeenmarked inorange in the corresponding cellsbelow. **To theextentanydifferencesbetween theprovisionsof theRoadsideAssistanceRegulationsand theproposed BasicBenefitRegulationshavebeen identified thatdoadverselyaffect the rightsof themembers to theKganyaBenefitsFundTrust, such changeshavebeenmarked in red in the corresponding cellsbelow. ***Materialdifferencesor changes indicated in red shading shallbeaccompaniedbya letter referencing thematerialdifferenceor change in the leftmostcolumnof the tableand the corresponding letter referencing suchmaterialdifferenceor changewillbeaccompaniedbyanexplanation for thematerialdifferenceor change. **** Capitalised termsused in this comparison shallhave themeaningascribed to them in thedocumentsconsidered in this comparison,unless indicatedotherwise a) Included toprovide for theapplicationof theConsumer ProtectionAct (to theextentapplicable). Provisionsof theBasicBenefitRegulations 3. Importantprovisions 3.1To theextent that theConsumer ProtectionActapplies to theseBasicBenefit Regulations, theTrusthasaduty topointout certain importantprovisions in theseBasic BenefitsRegulations. The clauseswhich contain these importantprovisionsand reasonswhy theyare importantare setoutbelow. 3.1.1 Limitationof risk, legal responsibilitiesand liability 3.1.1.1Regulation6.3.2.2.6, regulation6.3.3.4.2, regulation6.3.3.5.4and regulation6.3.4.2.4 are importantbecause they limitandexclude obligations, liabilitiesand legal responsibilities that theTrustandother personsor entitiesmayotherwisehave toaMember. 3.1.1.2Asa resultof these clauses,aMember's rightsand/or remediesagainst theTrustand theseother personsandentitiesare limitedandexcluded.These clausesalso limitand exclude aMember's right to recover or make claims for losses,damages, liabilityor harm a Member or othersmay suffer. 3.1.2AssumpƟonsof risk, legal responsibiliƟesand liabilityofandbyaMember 3.1.2.1Regulation6.2.3, regulation6.3.2.2.5, regulation6.3.3.5.4, regulation6.3.4.2.4and regulation6.3.4.4.6are importantbecauseaMember takeson risk, legal responsibilitiesand liability.Asa resultof these clauses,aMember mayalsobe responsible for claimsandother amounts. A Member willalsobe responsible for,andaccepts,various risks,damages,harm, and injurywhichmaybe sufferedbyaMember andothers for what is stated in these clauses 5. Master Regulations TheBasicBenefits Regulations (" BBRs ")mustat all timesbe read with theMaster Regulations,and all termsand conditions setout in theseMaster Regulationsapply to theBBRs. 4. Commencement 4.1TheseBBRs commencewitheffect from the CommencementDate and shallendureuntil terminatedby theTrust inaccordancewith the Master Regulations. 4.2TheBBRs replace in totalityallRegulations previously issuedby the Trustdealingwith the samemattersas setout herein,witheffect from theCommencement Date 6.1. and6.2.1Trust shallprocurebenefits 6.1TheTrust shallprocure certainBasicBenefits for thoseMembers who: (i)satisfy the requirements for Membershipas setout in theMaster Regulations; (ii)havepaid their MembershipContributions to theTrustas setout in theMaster Regulations;and (iii)qualifiesas Members inGood Standing for purposesof theBasicAncillaryBenefits. 6.1.2TheTrust shallprocure suchbenefitsusing itsbestendeavours in line with theFinancialSector Charter. 6.2The followingBasicBenefitswillbeprocuredand/or provided: (i) access to thePukwanayaKganyaContract for theprovisionof insurance cover and funeral (burial)benefits in termsofaFuneralPolicyand insurance cover anddreaddiseaseandpersonalaccidentbenefits in termsofaDreadDiseaseandPersonalAccidentPolicy; (ii) paymentof themonthlypremiumsdue in termsof thePukwanayaKganyaContract; and (iii) theBasicAncillaryBenefits. 6.3.2Road sideassistancebenefit 6.3.2.2.1. -TheTrustmayprocure theRoadside AssistanceBenefits from theService Provider for allMembers inGoodStanding. 6.3.2.2.3. -TheRoadside AssistanceBenefitswill,whenever applicable,be available to theMembers inGoodStanding for thedurationof their Journey,provided that such benefit shallonlybe available in respectof JourneysundertakenbyaMember inGood Standingwithin theperiod commencingonadate7 (seven) daysprior toanEventand enduringuntiladate7 (seven)daysafter theEvent. Road side assistancebenefit The reference to SouthAfrica isnot reflected in the BBR. 6.3.2Road side assistancebenefit 6.3.2.2.2The Roadside Assistance Benefitsentitleall Members inGood Standing to the benefits relating toaVehicleas set out inAnnexeA in theeventofa Journey toan Event inaVehicle. Road sideassistancebenefit 6.3.2.2.4. In theevent thata Member inGoodStanding requires theRoadsideAssistance Benefits, theTrust shallpay, to theServiceProvider, the costs for the roadside assistance limited to theamountsas setout inAnnexeA,asamended from time to timeby theTrust. 6.3.2.2.5. -Any costsover and above the limits stipulated in AnnexeA for the roadside assistance,willbe for the costof the relevantMember inGood Standing. 6.3.2 Limitationof Liability 6.3.2.2.6 It isagreed that the Roadside AssistanceBenefitsare abenefitprocuredby theTrust from theServiceProvider.The contractual relationship for the roadsideassistancewillbe between theMember inGood Standingand theService Provider.TheTrust's liability for theRoadsideAssistanceBenefits shallbe limited topaying the amountsas setout inAnnexeA to theServiceProvider for the incidentsand/or events listed in AnnexeA,asamendedby the Trust from time to time. Delegationand cession BBR doesnot make reference to this. Member inGoodStanding 6.3.2.3TheTrust shallonlyprovide theRoadsideAssistanceBenefits if theMember isaMember inGood Standingbyvirtueof (i)paymentof aMembershipContributionwitha DateofPayment in theMonth preceding theMonth inwhich the Roadside AssistanceBenefit is claimed; or (ii)paymentofaMembership ContributionwithaDateof Payment in theMonth inwhich the Roadside AssistanceBenefit is claimed,provided that theDateof Payment isprior to theDateof the claim for theRoadside Assistance Benefits. Amendments to theRegulations Notdealtwith in theBBR Termination TheBBRs shall endureuntil terminatedby the Trust in accordancewith theMaster Regulations.
