Issue,amendmentand terminationofRegulations 12.1TheTrust shall issue RegulaƟons inter alia seƫngout– 12.1.1 theBenefitsprovidedor procuredby theTrust for Members, andwhereapplicable, their Dependants, 12.1.2qualifying criteria for Members, 12.1.3 commencementdate for Benefits, 12.1.4 claim procedures, 12.1.5 suchother mattersasmaybe determinedby theTrust in accordancewith the trustdeed. 12.2TheRegulations setout in regulation12.1 shall include Regulations settingout theBurialBenefitsprovidedby theTrust. (a) 12.3The titleand commencementdateofRegulations issued in accordancewith regulation12.1 shallbe appended toSchedule3and suchamended schedule shall,on signatureby theTrust, formpartof theseMaster Regulations in substitution for anypreviousSchedule3. 12.4AnyRegulation issued inaccordancewith regulation12.1maybe terminatedor amendedby theTrust– 12.4.1 inaccordancewith theprovisions contained in suchRegulation, or 12.4.2 in theabsenceof suchprovisions, in suchmanner as theTrust maydetermine,and the terminationdate ("theTerminationDate")or amendmentdateof suchRegulation shallbe recorded inSchedule3,and suchamended schedule shallon signatureby theTrust, form partof theseMaster Regulations in substitution for anypreviousSchedule . 12.5TheRegulations specified inSchedule3whichhavenotbeen terminated inaccordancewith regulation12.4 shallbe theRegulations of theTrustand identifiedby thename specified inSchedule3. (b) 13Amendmentof theMasterRegulations TheMaster Regulationsmaybe amendedby theTrust inwriting in its solediscretion,and suchamendments shallbe incorporated into the Master Regulationswitheffect from thedate specified in such amendmentor in theabsenceof suchdate, thedateof signature thereofby theTrust (c) 14. Terminationof theMasterRegulations 14.1TheMaster Regulations shall commenceon theCommencement Dateand shallendureuntil terminatedby theTrust inaccordancewith regulation14.2. 14.2TheTrustmay terminate theseMaster Regulations inwritingand shall– 14.2.1givenoticeof theTerminationDateviaPayPoints, 14.2.2 simultaneously terminate theRegulations inaccordancewith regulation12.4. 14.3Notwithstanding theprovisionsof regulation14.2, theseMaster Regulations shallendure for purposesof settlingallobligationswhich were incurredonor before theTerminationDate (d) 15. DelegationandCession 15.1TheTrust shallbe entitled toappoint theAdministrator to perform administration services in relation to services tobeperformed inorder togiveeffect to theRegulations. 15.2TheMember maynot cedeany rightsor delegateanyobligations setout in theMaster Regulationsand/or theRegulations ConsumerProtectionAct This isnot specificallyprovided for herein e) 16. Issue,amendmentand terminationof the Regulations 15.1 Issue ofRegulations 15.1.1TheTrust shall issue the Regulations inter alia settingout - 15.1.1.1 theBasicBenefits in termsof theBasicBenefits Regulations; 15.1.1.2 theEnhancedBenefits in termsof theEnhancedBenefits Regulations; and 15.1.1.3suchother maƩersas maybe determinedby theTrust inaccordancewith theTrust Deed. 15. Issue,amendmentand terminationof theMaster Regulationsandallother Regulations 15.1.2TheRegulations specified in AnnexeE, shallbe theRegulationsof theTrust,and identifiedby thename specified inAnnexeE 15.1.3The titleand commencement dateof theRegulations issued in accordancewithAnnexeE (andas more fullydescribed in regulation 2.3)and suchamendedannexuresor schedule shall,on signatureby the Trust, form partof theseMaster Regulations in substitution for any previousAnnexeE. 15. Issue,amendmentand terminationof theMaster Regulationsandallother Regulations 15.2Amendmentof theMaster Regulationsand/or theRegulations 15.2.1TheMaster Regulationsand theRegulationsmaybeamendedby theTrust inwritingatany time in accordancewith theTrustDeed,and suchamendments shallbe incorporated into theMaster Regulationsandanyof the Regulationsasapplicable,witheffect from thedate specified in such amendmentor in theabsenceof suchdate, thedateof signature thereofby theTrust. 15.2.2TheTrust shallgivenoticeof theamendmentof theMaster Regulationsand/or Regulations through thePayPoints,aswellas the effectivedateof such change 15. Issue,amendmentand terminationof theMaster Regulationsandallother Regulations 15.3Terminationof theMaster Regulationsand/or theRegulations 15.3.1TheTrustmay terminate these Master Regulationsand/or anyof the Regulationsatany time inwritingand shallgivenoticeof the termination date thereofviaPayPoints. 15.3.2Notwithstanding the provisionsof regulation15.3.1, these Master Regulationsandallother Regulations shallendure for purposesof settlingallobligations whichwere incurredonor before the terminationdate thereof 18.5DelegationandCession 18.5.1TheTrust shallbe entitled toappoint the Administrator toperform administration services in relation to services tobe performed inorder togive effect to theRegulations. 18.5.2TheMember maynot cede any rightsor delegate anyobligations setout in the Master Regulationsand/or theRegulations 18.2ConsumerProtectionAct 18.3 Ifanypartof theMaster Regulationsand/or theRegulationsare regulatedbyor subject to theConsumer ProtectionAct, it isnot intended thatanypartof theMaster Regulationsand/or the Regulations contravene anyprovisionof theConsumer ProtectionAct. Therefore,allprovisionsof theMaster Regulationsand/or the Regulationsmustbe treatedasbeingqualified, to theextentnecessary, toensure that theprovisionsof theConsumer ProtectionActare compliedwith. 18.4 Noprovisionof the theMaster Regulationsand/or the Regulations: 18.4.1doesor purports to limitor exempt theTrustor anyother person or entity from any liability (including,without limitation, for any loss directlyor indirectlyattributable togrossnegligenceor wilfuldefaultor thatofanyother personacting for or controlledby theTrust) to the extent that the lawdoesnotallow sucha limitationor exemption; 18.4.2 requiresaMember toassume riskor liability for thekindof liabilityor loss, to theextent that the lawdoesnotallow suchan assumptionof riskor liability; or 18.4.3limitsor excludesanywarrantiesor obligationswhichare implied into the Master Regulationsand/or theRegulationsby theConsumer ProtectionAct (to theextent theyareapplicable)or which theTrust givesunder theConsumer ProtectionAct (to theextent theyare applicable), to theextent that the lawdoesnotallow them tobe limited or excluded 18Generalprovisionsapplicable to theMasterRegulationsandallotherRegulations 18.1 Interpretation 18.1.1Unless the context requiresotherwise - 18.1.1.1words impartingonegender shall include anyother gender; 18.1.1.2 the singular shall include thepluraland vice versa; 18.1.1.3a reference toanaturalperson shall include createdenƟƟes (incorporatedor unincorporated)and vice versa. 18.1.2Theheadingshavebeen inserted for convenienceonlyand shallnotbeused for nor assistnor affect interpretationof these Master Regulations. 18.1.3The failure toenforceanyprovision shallnot constituteawaiver of suchprovisionor affect inanyway the right to require performanceofany suchprovisionatany time in the future 18.6 Limitationof liability 18.6.1TheTrust's liability shallbe limited to theBenefitsas setout in theseMaster Regulationsand theRegulations. 18.6.2TheTrust's liability toprocureand/or provide theBenefits, shallatall timesbe limited toproviding suchBenefits toa Member – 18.6.2.1whomeets the requirementsof regulation6; 18.6.2.2whohaspaid theMonthlyMembershipContribution; and 18.6.2.3who is ingood standing in respectof theBasicAncillaryBenefitsand theEnhancedAncillaryBenefitsasdetermined in the Regulations. 18.6.3TheTrust isnot inanymanner liable for the insurancebenefitsprovided in termsof the InsuranceContractsand theTrust's onlyobligationand liability in termsof such InsuranceContracts is to– 18.6.3.1procureaces to 18.6.3.1.1 thePukwanayaKganyaContract (for Membersother thanChurchOfficialswhoareMembers); and 18.6.3.1.2 theThariyaBarutiPukwanayaKganyaContract (for ChurchOfficialswhoareMembers) from the Insurer; and 18.6.3.2pay theMonthlypremiumsdue in termsof thePukwanayaKganyaContractand theThariyaBarutiPukwanayaKganya Contract to the Insurer, in respectofMemberswhopaid their MembershipContribution to theTrust, subjectatall times to regulation7.4.4above 18.6.4Aperson shallnothavea claim or rightofactionarising from anyundertaking, representationor warrantynot included in theseMaster Regulationsand/or theRegulations 16. ComplaintProcedure 16.1 IfaMember hasaComplaint in respectofhis/her Membership, the MembershipContributionspaid and/or theBenefitsprovidedand/or procuredpursuant toMembership to theTrust, suchComplaints shallbe lodgedwith theAdministrator in the followingmanner: 16.1.1byemail to complaints@kganya.co.za; or 16.1.2 telephonically to0800000 538; or 16.1.3viaanyof theKganyaService Centreswhosedetailsare setout in AnnexeF,asamended from time to time,andwhichdetails canbe found on thewebsiteof theAdministrator athttps://mykganya.com. 16.2Any complaints in respectof the InsuranceContractsmustbedirected to the Insurer,or to the Administrator onbehalfof the Insurer,as setout in the Insurance Contracts 17. Cooling-Off 17.1AMember isentitled to cancelhis/her Membership to theTrust withinaperiodof31 (thirtyone)days from theDateofPaymentof the initialMembershipContribution,unlessaBenefithasbeen claimedor paid. 17.2 IfaMember elects to cancelhis/her Membership to theTrust as contemplated in regulation17.1, it shallbedeemed that the Member similarlyexercisedhis/her cooling-off rights in termsof the InsuranceContract.The insurance cover andbenefitswill, in such event,bedealtwith in themanner prescribed in the Insurance Contracts. 17.3Noticeby theMember to cancelhis/her Membership in terms of regulation17.1, shallbe deemed tobenotice to the Insurer in termsof the InsuranceContracts,and vice versawhereby cover and benefits in termsof the InsuranceContractandMembership to the Trustwillcome toanendat the same time 17.4TheTrust shall in such instance repay the initialMembership Contributionand theMembershipBookPurchasePrice to the Member and such former Member shallnothave 17.4.1anyClaim and/or entitlement to theBenefits in termsof the TrustDeed, theseMaster Regulationsand/or theRegulations; and 17.4.2any claim and/or entitlement to cover andbenefits in terms of the InsuranceContracts. 16.4The insurance cover andbenefitswill, in suchevent,bedealt with in themanner prescribed in the InsuranceContracts.
