Continuous Amendments to Thari Ya Baruti Membership Terms and Conditions

1. MASTER REGULATIONS AND ENHANCED BENEFITS REGULATIONS 10
1.1 The conditions of Membership to the Trust and the entitlement to benefits are set out in the Master Regulations, read with the Enhanced Benefits Regulations issued by the Trust in terms of the Trust Deed, as amended from time to time. 10
1.2 Copies of the Master Regulations and the Enhanced Benefits Regulations are included in this Membership Terms and Conditions Booklet as Annexe A and Annexe B, respectively. 10
1.3 Changes to any terms and conditions as set out in the Master Regulations or Enhanced Benefits Regulations will be incorporated in updated Annexures which will be made available to you from time to time. 10

2. ELIGIBILITY FOR MEMBERSHIP TO THE TRUST FOR ALL PERSONS WHO BECOME MEMBERS OF THE TRUST AFTER THE EFFECTIVE DATE 11
2.1 To be a Member of the Trust you must: 11
2.2 You must also complete an MPP Form to become a Member of the Trust and must submit the completed MPP Form to a Pay Point for inclusion in the Payment Receipt Booklet. 11
2.3 A person who satisfies the above requirements shall be a Member from the later of the date of issue of the Membership Book, or the date of payment of an initial Membership Contribution. Note that the date of payment is determined as provided for i... 11
2.4 A Member shall continue to be a Member for as long as such person remains a member of ZCC. 11
2.5 Note, in terms of the Trust Deed and the Master Regulations that the Trust may terminate your Membership where you no longer meet the requirements for Membership of the Trust, even if you are still a member of the ZCC. 11
3. EXISTING MEMBERS 11
3.1 All Members who were a Member of the Trust at the Effective Date, shall qualify as an Existing Member. 11
3.2 If you are an Existing Member, you will remain a Member of the Trust provided that you must meet and continue to meet the requirements for Membership to the Trust as set out in paragraph 2 above. 11
4. MEMBERSHIP BOOKS: HOW THEY WORK 12
4.1 A Membership Book consists of, amongst others, this Membership Terms and Conditions Booklet and the Payment Receipt Booklet. Existing Membership Books are addressed under paragraph 5 below. 12
4.2 This Membership Terms and Conditions Booklet includes the terms and conditions applicable to Membership, as well as all information in respect of the Enhanced Benefits provided and/or procured as part of Membership to the Trust. 12
4.3 The Payment Receipt Booklet provides for the affixing of Receipts as evidence of payment of your Membership Contributions, and any other receipts issued by the Trust (such as the Leeto la Moria Receipts), conclusion and inclusion of the MPP Form a... 12
4.4 The Membership Book Purchase Price of new, replacement and continuation Payment Receipt Booklets to be paid by Members will be determined by the Trust from time to time. Notice of such cost will be given through the Church Branches. 12
5. EXISTING MEMBERSHIP BOOKS TO REMAIN IN CIRCULATION 12
5.1 To the extent that you were a Member of the Trust before the Effective Date and have previously purchased a Membership Book from the Trust ("Existing Membership Book"), it should be noted that: 12
5.1.1 All terms and conditions in any Existing Membership Book are repealed and replaced with the terms and conditions contained in this Membership Terms and Conditions Booklet with effect from the Effective Date. 12
5.1.2 Your Existing Membership Book will: 12
5.1.2.1 continue to remain in force in respect of - 12
5.1.2.2 continue to be used for purposes of Receipts issued prior to, and after, the Effective Date pursuant to payment of Membership Contributions, and will therefore become and be treated as your Payment Receipt Booklet. 13
5.1.3 This means, with effect from the Effective Date, that: 13
5.1.3.1 all terms and conditions in an Existing Membership Book will be replaced with the terms and conditions in this Membership Terms and Conditions Booklet; and 13
5.1.3.2 an Existing Membership Book will continue to be used as a Payment Receipt Booklet until such time when a continuation Payment Receipt Booklet or a replacement Payment Receipt Booklet is required and acquired by you. 13
5.2 As an Existing Member, you will not be required to pay for the Membership Terms and Conditions Booklet and will receive this free of charge by virtue of Membership to the Trust as at the Effective Date. 13
5.3 However, if you lose your Existing Membership Book or if your Existing Membership Book is full (it being understood that your Existing Membership Book will constitute a Payment Receipt Booklet with effect from the Effective Date), you will be requ... 13
6. MEMBERSHIP CONTRIBUTIONS 13
6.1 As a Member you must at all times pay a Membership Contribution each Month to the Trust. 13
6.2 The Trust shall determine the Membership Contribution payable from time to time in respect of the Enhanced Benefits. 13
6.3 The Membership Contribution is due and payable on the first day of each Month but you are entitled to pay it at any time during the Month, but before the last day of the Month. 13
6.4 Payment of the Membership Contribution entitles you as a Member to the Enhanced Benefits, subject to the conditions as set out in the Enhanced Benefits Regulations, read with the Master Regulations. 14
6.5 If you fail to pay a Membership Contribution(s) or any portion thereof4F , you may forfeit the benefits of Membership to the Trust. This normally leads to loss of valuable benefits and should be avoided where possible. 14
6.5A You must pay the full Membership Contribution every Month. If you cannot afford the full Membership Contribution, or only want some and not all of the benefits of Membership to the Trust (such as insurance cover), then Membership to the Trust is... 14

7. ACTIVATION OF MEMBERSHIP 16
7.1 To activate your Membership, you should approach a Committee Member of your Church Branch and request the documents to be completed to become a Member of the Trust. 16
7.2 The Committee Member will provide you with the Membership Terms and Conditions Booklet for consideration. 16
7.3 Once you have considered the information contained in the Membership Terms and Conditions Booklet, and would like to proceed with Membership to the Trust, the Committee Member will provide you with a Payment Receipt Booklet. 16
7.4 The Committee Member will indicate the MPP Form contained in the Payment Receipt Booklet for completion by yourself, and take receipt of the Membership Book Purchase Price and your initial Membership Contribution. 16
7.5 If you are an Existing Member, your Membership will remain in force and you do not have to activate your Membership again as explained in paragraph 3 above. 16
8. COOLING-OFF 16
8.1 You are entitled to cancel your Membership to the Trust within a period of 31 (thirty-one) days from the date of payment of the initial Membership Contribution, unless a Benefit has been claimed or paid. 16
8.2 In such an event, it shall be deemed that you similarly exercised the cooling-off rights in terms of the Thari ya Baruti Pukwana ya Kganya Contract, whereby cover in terms of the Thari ya Baruti Pukwana ya Kganya Contract and Membership to the Tru... 16
8.3 Notice by you to cancel your Membership as a result of your cooling-off rights, shall be deemed to be notice to the Insurer to cancel the Thari ya Baruti Pukwana ya Kganya Contract, and vice versa. 17
8.4 The Trust shall in such instance repay the initial Membership Contribution and the Membership Book Purchase Price to you and you will not have any claim and/or entitlement to the Enhanced Benefits. 17

9. ENHANCED BENEFITS 17
9.1 Introduction 17
9.1.1 By paying a Membership Contribution and becoming a Member of the Trust, such Membership entitles you to all the Enhanced Benefits as set out in this Membership Terms and Conditions Booklet, read with the Master Regulations and the Enhanced Benef... 17
9.1.2 The Enhanced Benefits offered as part of Membership to the Trust, consist, amongst others, of access to certain insurance benefits, as follows: 17
9.1.2.1 Firstly, access to the Thari ya Baruti Pukwana ya Kganya Contract, being an insurance contract with the Insurer as arranged by the Trust, which provides the following insurance benefits: 17
9.1.2.2 Secondly, as long as you pay your Membership Contributions to the Trust, the Trust will pay the Premiums and Additional Premiums in terms of the Thari ya Baruti Pukwana ya Kganya Contract to the Insurer. However, if you fail to pay the Members... 18

10.2 Any complaints in respect of the Thari ya Baruti Pukwana ya Kganya Contract must be directed to the Insurer, or to KIA on behalf of the Insurer, as follows: 28
11. IMPORTANT PROVISIONS IN TERMS OF THE CONSUMER PROTECTION ACT 28
11.1 By accepting the terms and conditions of Membership, you acknowledge that you understand, in respect of liabilities, legal responsibilities, assumption of risks and indemnities: 28
11.1.1 the Master Regulations and the Enhanced Benefits Regulations contain certain provisions that limit or exclude obligations, liabilities and legal responsibilities that the Trust and other persons may otherwise have had towards you as a Member; 29
11.1.2 the Master Regulations and Enhanced Benefits Regulations contain certain provisions that impose an obligation on you as a Member to take on risk, legal responsibility and liability; and 29
11.1.3 by concluding a Membership, you agree to hold the trustees of the Trust harmless against claims, loss, damages, and harm that may be suffered by the Trust and other persons or entities to the extent set out in the Trust Deed. 29

12. CONSENT TO PROCESSING OF PERSONAL INFORMATION BY THE INSURER, KIA AND THE TRUST 30
12.1 Pursuant to your Membership to the Trust, you understand and expressly consent, in respect of the information that you complete on the MPP Form or the AMPP Form, that: 30
12.1.1 the information that you provide will be used for purposes of your Membership to the Trust. 30
12.1.2 the information will be provided by the Trust (and/or its administrator, KIA) to the Insurer for purposes of the Thari ya Baruti Pukwana ya Kganya Contract. 30
12.1.3 the information will be used by KIA to administer i) membership to the Trust, on behalf of the Trust; and ii) the insurance benefits in terms of the Thari ya Baruti Pukwana ya Kganya Contract, on behalf of the Insurer. 30
12.2 You further consent and understand that: 30
12.2.1 The Trust, KIA and the Insurer will process and protect your personal information as required by relevant laws and the Constitution of the Republic of South Africa. This may include health and financial information. 30
12.2.2 The privacy policy of the Insurer, KIA and the Trust is available as follows: 30
12.2.3 The Trust, KIA and the Insurer collect, process, collate, store, analyse and disclose personal information for the following purposes: 30
