More than twenty years ago, I created the Kganya Benefits Fund Trust (“ Trust ”) for the benefit of the ZCC congregation. Under my direction the Trust has, for many years, granted access to essential benefits for ZCC members who pay their monthly membership contributions and who are in good standing (“ member beneficiaries ”). These benefits include cost-effective burial, dread disease and personal accident cover (“ insured benefits ”); and other benefits such as Leeto la Moria benefits, roadside assistance benefits, funerary management benefits; and good health assessment benefits (in the case of church committee members who are member beneficiaries) (" non-insured benefits "). With my fellow trustees of the Trust, I have always ensured that the Trust’s operations are fully compliant with the relevant legislation. To remain compliant, the Trust has no choice but to effect certain changes due to a change in the insurance law which impact the manner in which the Trust operates. An amendment to the trust deed of the Trust, and an amendment and/or repeal and replacement of the regulations issued by the Trust, are therefore required. The amendments will affect both the insured benefits and the non-insured benefits (collectively " the changes "). This document constitutes notice of the changes to your membership as a result of such amendments. Our records show that you are a member of the Trust and qualify as a member beneficiary. If you are not a member of the Trust and do not qualify as a member beneficiary, you may disregard this notice. As a trustee of the Trust, I can assure you that every effort has been taken to ensure that your benefits remain the same and your interests as a member beneficiary are protected and will not be negatively affected as a result of the required changes. In order to approve the changes, the trustees of the Trust will apply to the High Court of South Africa (Gauteng Division, Pretoria) in terms of section 13 of the Trust Property Control Act 57 of 1988 (" the Court Application ") to approve the changes. The High Court will therefore carefully consider the changes, and make sure that your interests as a member beneficiary remain protected. The purpose of this important notice is to explain in detail the changes, and the effect thereof on your membership rights as a member beneficiary. Membership to the Trust • If you are a member of the Trust, you will remain a member of the Trust. • You will qualify and continue to qualify as a member beneficiary, entitled to the benefits of the Trust, for as long as you pay your monthly membership contributions. Payment of membership contributions • As a member of the Trust, you must continue to pay your monthly membership contribution at the various Church branches. As has been the practice to date, a receipt will be issued to you when you pay your monthly membership contribution. • The church committees will deposit the proceeds of membership contributions into a bank account in the name of the Trust. • By paying your monthly membership contributions, you ensure your membership to the Trust as a member beneficiary. • Please note that your monthly membership contributions will remain the sam e and will not change or be affected as a result of the changes. The insured benefits: burial, dread disease and personal accident cover • Currently, all member beneficiaries received cover for burial benefits, dread disease and personal accident benefits through group policies procured by the Trust and underwritten by Sanlam Developing Markets Limited (" Sanlam ").
